A federal appeals court has reinstated the conviction of a Libyan and two associates accused of conspiring to dupe the United States into granting tax-exempt status to a defunct Muslim charity by hiding its pro-jihad activities
The court has reinstated the jury's guilty verdict against Libya's Emadeddin Muntasser, Samir Al-Monla and Muhammed Mubayyid. They led the defunct Boston-based Care International Inc. A jury convicted them in January 2008. But a U.S. District Court judge overturned the tax conspiracy conviction, saying that the evidence didn't support the verdict. The district court will sentence Al-Monla and re-sentence Muntasser and Lebanese national Mubayyid. Mubayyid's attorney says that his client was deported after serving his original sentence.
